The personal injury specialists here at Cunningham Dalman are warning clients that the technical details required to successfully litigate an injury claim against a careless store owner are becoming more complicated.
Here in Michigan, an unsuspecting customer was squashed while trying to enter a grocery store. The sensors on the automatic doors at the front entry were outdated and the doors malfunctioned, seriously injuring her.
You would think that getting injured by an automatic door was bad enough.
To add insult to injury, it was discovered that the company that serviced the doors for the store owner had warned them that the sensors needed to be upgraded.
Despite these facts, the Court of Appeals squashed the injured woman’s case because her lawyer had not obtained the proper expert witness to explain the case to the jury.
This only goes to show that getting through the courthouse doors may be tougher than you think.
